Alarming that over 2.7 lakh cases pending in Karnataka High Court: Chief Justice PB Varale

Karnataka High Court Chief Justice PB Varale on Tuesday opined that there is an urgent need to clear pending cases in courts in the State, considering that there are over 2.7 lakh cases pending before the three benches of the High Court..The backlog of cases remains a concern and "we must redouble our efforts to clear pending cases and provide speedy justice," the Chief Justice said."It is alarming to note that the total pendency of cases in High Court including two benches at Dharwad and Kalaburagi is 2,72,041 cases. Further, in our state a total number of 2,28,079 civil cases and 43,962 criminal cases are pending as on 8th August, 2023," he added.He also noted that Alternative Dispute Resolution mechanisms can play a vital role in reducing case pendency, thereby easing the burden on courts and enhancing access to justice..Chief Justice Varale was speaking at an event organized to mark the 77th Independence Day.In his speech, he highlighted that the judiciary plays a vital role in preserving the rule of law and ensuring the integrity of the Constitution. This is crucial for any nation and this holds true for Karnataka as well, he observed. "The courts are entrusted with the responsibility of ensuring that justice is not a privilege of the few but a right for all, regardless of their background or circumstances. Our judiciary, guided by the principles enshrined in the Constitution, acts as the custodian of justice, fairness and equality," he emphasised..Judicial independence is the cornerstone of a vibrant democracy and it is essential for the judiciary to function without any fear, favour or bias, he went on to observe. He went on to assure that the judiciary in Karnataka remains committed to upholding its independence. "As Chief Justice, I assure you that our judiciary in Karnataka remains committed to upholding its independence, without yielding to any undue influence or pressure. An independent judiciary is essential to safeguard the rights and liberties of citizens and to maintain the delicate balance of power between the three pillars of our democracy," he said..The judge also touched upon the importance of integrating technology into the justice delivery system, which he opined was both necessary and inevitable. Embracing technology can streamline court processes, expedite, disposal and enhance transparency, he added. However, he cautioned that a balance should be struck between modernisation and preserving the sanctity of courtroom proceedings as well as the human touch in dispensing justice..Chief Justice Varale further emphasized the need for more investment in court infrastructure and appealed to the government to offer support on this front. "Timely recruitment of judges, continuous training, and capacity building are crucial to enhance the efficiency and effectiveness of our courts. I appeal to the government and all stakeholders to prioritize and support the strengthening of our judicial infrastructure," he added..On a related note, the High Court on Monday asked the State government to submit at least three proposals to the Chief Minister for the expansion of the High Court building in Bengaluru.
