The Delhi High Court on Thursday clarified that a lawyer appearing before the Supreme Court, High Courts or district courts must wear white bands and the law interns can come to courts wearing black tie, coat, pant and white shirt..Justice Prathiba M Singh said that in terms of the resolution passed by the Bar Council of Delhi (BCD) which mandates black tie, coat, pant and a white shirt for interns, the circular of the Shahdara Bar Association (SBA) saying that interns should wear blue coat would not survive..The court was hearing a plea by a a second-year law student named Hardik Kapoor challenging the circular issued by SBA.In an order passed on December 1, the court had stayed the resolution and directed the BCD to convene a meeting of all bar associations in the national capital and other stakeholders, to reach a consensus on what uniform, law interns should wear..The Court was informed today that the BCD has passed a resolution on December 16 wherein it has sad that for interns, the distinguishing feature would be a black tie.Advocate Ujwal Ghai appeared for the petitioner and said that the SBA circular is without authority of law as the formulation of rules regarding the uniform of lawyers and interns is the prerogative of the Bar Council of India and Bar Council of India has already made the Rule 27 of Bar Council of India Rules of Education, 2008 which is currently in force..After considering the case, the bench said that in view of the resolution passed by the BCD, the SBA circular would not survive.The Court, therefore, dispose of the plea.
