Accusations made in complaint to lawful authority in good faith cannot attract offence of defamation: Supreme Court

The Court relied on Exception 8 to Section 499 of the Indian Penal Code to note that allegations made in a complaint addressed to the SDM will constitute the offence of defamation.

The Supreme Court recently reiterated that accusations made in a complaint against a person, in good faith, to those who have lawful authority over such person, will not constitute the offence of defamation [Kishore Balkrishna Nand v. State of Maharashtra and Another].
