Prabhakar Gwal, Chief Judicial Magistrate of Sukma district in Chhattisgarh has been terminated from service, reports The Hindu..Gwal was apparently not given any reason for the same except that his termination was in “public interest”..According to India Resists, Gwal had questioned the manner in which the police used to indiscriminately arrest tribal people in the conflict zones of Chhattisgarh. The Superintendent of Police had complained to the district judiciary about the judge, stating many of Gwal’s decisions were “adversely affecting the morale of the security forces”..Gwal had joined the Bench in 2006 after 10 years of law practice. In his statement to The Hindu, Gwal has alleged that he has been “unfairly targeted” for delivering “impartial and unbiased” judgments..Gwal’s judgments include the suicide of IPS officer Rahul Sharma and the Para Medical Test paper leak. Gwal had refused to accept the CBI’s closure report in the IPS officer’s suicide case. In the Para medical paper leak case, he had sentenced six persons to imprisonment..Gwal was also in news when he had written to the Chhattisgarh Chief Secretary demanding the removal of Collector of Sukma, Niraj Bansod..Although it is not immediately clear whether Gwal’s allegations are true, the judicial institution in Chattisgarh has been prone to attacks of late. Recently, the Bar Association of Bastar had virtually driven out Jagdalpur Legal Aid Group (JagLag), a group of lawyers who had been sympathising with the Adivasi cause.
