Law student moves Bombay High Court over professor tearing up answer sheet

A law student has moved the Bombay High Court against Pune's DY Patil Law College and a professor for tearing up his answer sheet during an exam, as well as subsequent proceedings initiated against him [Gaurav Dnyandeo Kakade v Student Grievance Redressal Committee, DY Patil Law College and Ors.]..On July 11, Justices AS Chandurkar and Rajesh S Patil issued notice on the plea and ordered the preservation of relevant CCTV footage..According to the petitioner, on June 8, he sent an email to the University and College requesting additional sheets for his examinations, as the standard 36 pages were insufficient for him.He alleged that during an exam on June 11, an assistant professor, who was inebriated, taunted him about the email and tore up his answer sheet while collecting it.The student's plea stated that after he approached the Principal and the College, he was assured that his grievance would be addressed. However, instead of resolving the issue, the Chief Examination Officer asked the student to falsely admit to using unfair means during the examination.It further stated that the next day, the student's request to replicate his torn answer sheet or at least join the torn answer sheets was rejected by the Principal, who instead adopted the suggestion of the Chief Examination Officer.Eventually, the student was allowed an opportunity to replicate his torn answer sheet on a fresh sheet of paper. However, after being made to wait for 45 minutes, he was allegedly informed that he would only be allowed to write his name and other details on the sheet. He claimed that he was then threatened with rustication from the college.This led to representations before the Governor, the State Minister of Higher Education, the Bar Council of Maharashtra and Goa, the Vice Chancellor of the University, and others.Subsequently, the student said that he was was summoned by the Student Grievance Redressal Committee of the college, which he has alleged was biased and filed a report against him without any application of mind..The student has, therefore, approached the High Court for relief. He has sought the quashing the report against him, the constitution of an appropriate redressal committee to swiftly address his grievances, and permission to attend college pending the disposal of his petition..The petitioner (student) was represented by advocates Sanket Bora, Vidhi Punmiya, Amiya Rajan Das and Unnatti Thakkar, instructed by SPCM Legal.
