A Supreme Court Bench headed by the Chief Justice Dipak Misra and comprising Justices AM Khanwilkar and DY Chandrachud today took strong exception to the arguments advanced by advocate JP Dhanda in the case relating to PNB scam..Dhanda was arguing a petition filed by his son Vineet Dhanda seeking the Court’s indulgence for issuing directions to the investigating agencies to register a case against the “top management” of PNB in the scam..His plea inter-alia also prays that directions be given to the agencies to expedite the deportation of Nirav Modi and others involved in the scam..When the matter came up for hearitng today, Attorney General KK Venugopal had submitted that a probe into the PNB scam is in progress. He also submitted that arrests have also been made while carrying out the investigation. The Attorney General, therefore, objected to the prayers mentioned in the petition which called for a Court monitored investigation..“There cannot be any parallel investigation” submitted the Attorney General..In response, Dhanda submitted that his petitions contain eleven prayers and does not include the one mentioned by the AG. He further submitted that the AG must be referring to some other petition filed by someone else while also stating that the AG has not read his petition..Justice Khanwilkar taking exception to the arguments said,.“Why do you presume he has not read your petition? Is this the way to argue?”.Expressing his agreement over the remarks of Khanwilkar J., Justice Dipak Misra while adjourning the matter observed that,.“The Attorney General holds a Constitutional post and no one should ask him whether he has read the brief or not.”.Justice Misra also observed that the language used in the Court must be decorous and appropriate..The matter will now be heard on April 9
