Controversial judge Justice CS Karnan today failed to appear in the suo motu contempt case against him in the Supreme Court..When the seven-judge Bench assembled to hear the case today, the sitting judge of Calcutta High Court was not present. There was no advocate representing him either..Attorney General Mukul Rohatgi then made submissions with respect to the letter written by Karnan J. to the Registrar General of the Supreme Court..“I don’t find any appearance by him. The letter by him further aggravates the position. It is on WhatsApp and is all over media as well. The letter goes on to make many allegations. All this interferes with the administration of justice. It is unfortunate that these kind of things are going on. Your Lordships should act.”.Rohatgi suggested that the court should frame a formal charge against him and ask him to respond to that..The Court considered various options, before deferring the matter for three weeks. The Bench said,.“Despite due notice, Shri Justice C.S. Karnan has not appeared. No one has been authorised by Shri Justice C.S. Karnan to represent him today. In any case, no one having a power of attorney, has represented him today. We are not aware of the reason(s) for his non-appearance. It is therefore, that we refrain from proceeding with the matter as of now.”.The Court then proceeded to post the matter for hearing on March 10 while directing Justice Karnan to be present in Court in-person that day..“Post for hearing on 10.03.2017 at 10.30 a.m. Sri Justice C.S. Karnan is directed to be present in Court in person, on the next date of hearing.
