Kalyug has arrived: Allahabad High Court on maintenance dispute between elderly husband and wife

The Allahabad High Court recently remarked that "Kalyug has arrived" while hearing a maintenance case between an elderly couple in their late 70s.

The Court was hearing an application filed by 80-year-old Munesh Kumar Gupta challenging a family court's order directing him to pay ₹5,000 in maintenance to his wife.

A Bench of Justice Saurabh Shyam Shamshery observed,

"It appears that Kalyug has arrived since a couple of aged about 75-80 years is fighting a legal battle against each other for maintenance."

Gupta and his 76-year-old wife have reportedly been involved in a property dispute since 2018. The matter escalated to the police, after which the couple was referred to a family counseling center.

As the dispute remained unresolved, Gupta and his wife began living separately. The wife then filed a plea in family court, seeking alimony of ₹15,000 from her husband, whose monthly pension amounted to approximately ₹35,000.

In its February 16 order, the family court directed Gupta to pay ₹5,000 as alimony. However, he challenged this decision before the High Court.

The High Court, after issuing notice to the wife in the matter, scheduled the case for a final hearing, expressing hope that the parties might reach a settlement by then.

Advocates Ghanshyam Das Mishra and Sunil Kumar Shukla appeared for the applicant.
