Prashant Bhushan today filed a Right to Information (RTI) application seeking information on how the Constitution Bench that heard the petition related to the impeachment motion against Chief Justice Dipak Misra was formed..The Bench, while hearing a petition challenging Vice President Venkaiah Naidu’s order to reject the notice of motion of impeachment against CJI Misra, refused to divulge details as to how the Bench was formed..And after the petition filed by Members of Parliament Partap Singh Bajwa and Amee Yajnik was dismissed as withdrawn, Bhushan filed the RTI in a bid to unearth details the Supreme Court refused to part with..The RTI seeks to procure information regarding the order that placed the matter before a five-judge Constitution Bench. The two questions asked in the RTI are firstly, whether this particular matter which concerns the Chief Justice of India was listed before a Constitution Bench via an administrative order, and secondly, who passed this order..Additionally, Bhushan has also sought to procure a copy of this order..Bhushan, along with Sunil Fernandes and Senior Advocate Kapil Sibal, had appeared for the petitioners in the case today, while Attorney General KK Venugopal represented the Chairman of the Rajya Sabha and ASG Tushar Mehta appeared for the Central Government..The main issues raised by Sibal while making his submissions in the case also revolved around the same questions raised in the RTI..However, the Constitution Bench of Justices AK Sikri, SA Bobde, NV Ramana, Arun Mishra and AK Goel had refused to divulge the details of the order that set up the Constitution Bench to hear this matter, and also refused to provide a copy of this order to the petitioners..Sibal had mentioned the matter regarding the rejection of the notice of impeachment motion against CJI Misra before Justice Jasti Chelameswar yesterday.
