In an unexpected turn of events, the petition challenging the Rajya Sabha Chairman’s order rejecting the notice of motion filed to remove Chief Justice of India Dipak Misra was withdrawn today.
The petition was withdrawn after the Constitution Bench set up to hear the case refused to give details of the administrative order constituting the Bench.
Appearing for the petitioners, Senior Advocate Kapil Sibal requested that details of the order constituting the Bench be provided, so that the petitioners could decide whether or not to challenge the same.
However, he Bench refused to do so, asking Sibal to argue on the merits of the petition. At this juncture, the petitioners withdrew the plea.
Filed by two Members of Parliament – Partap Singh Bajwa and Amee Yajnik – the petition was heard by a Bench of Justices AK Sikri, SA Bobde, NV Ramana, Arun Mishra and AK Goel.
