Hindu widow has absolute ownership of property she is being maintained out of: Supreme Court

The Court reiterated that a Hindu woman’s right to maintenance was not an empty formality or an illusory claim being conceded as a matter of grace and generosity.

The Supreme Court on Wednesday held that in lieu of a Hindu widow's right to maintenance and by virtue of Section 14(1) of the Hindu Succession Act, 1956, she is entitled to absolute ownership of the property she is being maintained out of [Munni Devi Alias Nathi Devi v. Rajendra Alias Lallu Lal].
