Hadiya: Look-out circular for two witnesses; Eventful hearing in the offing tomorrow in SC

An eventful hearing is in store in the Hadiya case tomorrow in Supreme Court as the National Investigation Agency (NIA) and Sainaba, who is Respondent no. 8 in the petition, have submitted fresh affidavits in the Supreme Court..The NIA’s affidavit is only four pages long and in the same, it has denied allegations by Hadiya that the NIA did not read out her statement after it was recorded..“The allegation that her statement was not read over to her is completely incorrect and the same is therefore denied.”.NIA has also denied that the allegation that its officials were prejudiced towards her “as if she is a criminal or a terrorist”..However, what is most interesting in the short affidavit filed by NIA is that the NIA has submitted that it has issued look-out circulars for two witnesses, Fasal Musthafa and Sherin Shahana..These two witnesses are those who had, according to Hadiya’s father Asokan, initiated Hadiya into Islam. Asokan in his affidavit had submitted that Hadiya embraced Islam after coming into contact with one Shanib who introduced Hadiya to Shanib’s elder sister Sherin Shahana..Sherin was already married to Fasal Musthafa, who offered Hadiya to become his second wife whereupon he would take her to Yemen. According to Asokan, Fasal and Sherin even took Hadiya to Ernakulam and got an affidavit sworn before an Advocate and Notary to the purported effect that Hadiya had become a Muslim..Subsequently, Hadiya disclosed this episode to her close friend Ambily who strongly objected to Hadiya’s decision and consequently, Hadiya backtracked..The NIA has now issued Look-out circulars for Sherin and Fasal as they had left India before NIA commenced its probe and are currently in Yemen..Meanwhile, Sainaba, the President of National Women’s Front (the women’s wing of PFI), has also filed her affidavit in response to Asokan’s affidavit..Sainaba, who is Respondent 8 in the case, has stated in her affidavit that Asokan is acting at the behest of “evil forces” and they are not hesitant in stating “utter falsehood” even before the “apex court of the land”..“It is very clear from the averments in the said Additional Affidavit that the 1st respondent is proving time and again that he and the evil forces behind him do not have any remorse or hesitation in repeating utter falsehood even before the Apex Court of the land with their malicious intentions of misleading this Hon’ble Court and thereby attempting to achieve their evil motive of travesty of justice and destruction of the harmonious and peaceful living of the citizenry of this country”..The affidavit states that highly influential evil forces “have got behind” Asokan and that a “wide range of gigantic network of wholly dishonest media” and other “evil organisations” motivated by Islamophobia are threatening the peace in the country..The matter is listed as item 1 tomorrow before the court of Chief Justice of India..Read the affidavits filed by NIA and Sainaba below.
