Gratuity has to be calculated from the day it became payable and not from date of disbursement: Kerala High Court

Justice Murali Purushothaman held that as per the Payment of Gratuity Act, 1972, the maximum amount of gratuity payable to an employee has to be determined with respect to the date on which his employment was terminated.

The Kerala High Court recently held that as per the Payment of Gratuity Act of 1972, the maximum amount of gratuity payable to an employee has to be determined with respect to the date on which the gratuity becomes payable to them (termination of employment) and not the date on which the amount has to be disbursed to them [K Rajendra Prasad v State of Kerala & Ors.].
