Share details with police stations about woman into honey trapping to prevent false rape cases: Madhya Pradesh High Court

The Madhya Pradesh High Court recently ordered that information about a woman who had filed a false rape complaint be shared with all police stations to prevent further false implication of men in such cases [Jitendra Kumar Mishra v The State of Madhya Pradesh]..Justice Vishal Dhagat found that the complainant-woman had registered three similar cases against different men, accusing them of rape on the pretext of false promise of marriage..Therefore, the judge directed the police to share information about the complainant-woman with other police stations to prevent registration of more such honey traps.."Copy of this order be sent to concerned Police Station and information regarding the complainant/prosecutrix 'X' be uploaded in inter operable Criminal Justice System so that Police Stations shall have information in advance regarding the modus operandi of the prosecutrix in laying honey trap and falsely implicating innocent persons in false cases," the Court's order said..The Inter-operable Criminal Justice System (ICJS) allows the sharing of information among different pillars of the criminal justice system, like courts, police, jails and forensic science laboratories on one platform..The Court was hearing a petition challenging a First Information Report (FIR) registered against one, Jitendra Kumar Mishra. The complainant had accused him of establishing physical relationship with her on the “false promise of marriage.".Mishra denied the allegations. The Court was told that he met the complainant through Facebook and that she had set a “honey trap” to entrap Mishra and blackmail him. .Since the complainant did not appear before the Court, the bench proceeded to deal with Mishra's plea without hearing her. The Court was told that the complainant-woman had filed two similar FIRs against other men whom she had met through Facebook and then accused of rape.It was also informed that the woman was already married to a man at Arya Samaj Mandir, who was also accused of rape by her. .Considering that the complainant was already married, the Court pointed out that she could not claim that she was raped on the pretext of marriage.“She is already a married woman, therefore, a common man with average reasoning will not believe that she will be misled by false promise to marry by another person. There is little or no possibility that she will believe a person that he will marry her and will establish physical relationship with her, when she herself is not a divorced or not able to do second marriage,” the Court said..Thus, the Court concluded that the complainant was using the same modus operandi to lodge false rape FIRs and misuse the law to “grind her own axe.” The Court, therefore, quashed the case against Mishra and allowed his plea. .Advocate Shreyash Pandit represented the petitioner.
