However, the Supreme Court said that the order shall not be treated as precedent because the High Court had dealt with the merits of the case..A Division Bench of Justices Suresh Kumar Kait and Manoj Jain was hearing Imam's bail plea in the case today. .The Bench said Imam’s counsel and Delhi Police shall also file their written submissions in the matter.It then listed the case for further proceeding on February 19..Special Public Prosecutor (SPP) Amit Prasad appeared for Delhi Police and said that as per the Supreme Court's order dismissing Delhi Police's appeal against bail to Tanha, Kalita and Narwal it is for Imam to make his case on merits and not for the prosecution to show how their role is different from the ones granted bail. .Delhi Police has alleged that Imam is one of the key conspirators in the 2020 Delhi riots case. It is the prosecution’s case that Imam and others conspired to organise riots using the protests against Citizenship Amendment Act (CAA) and National Register of Citizens (NCR) as a front.The Bench headed by Justice Kait is hearing Imam’s bail plea afresh after Justice Siddharth Mridul (who had heard the case in detail) was elevated as Chief Justice of Manipur High Court.
