The Delhi High Court on Thursday asked the Delhi Police to clarify whether the investigation in the 2020 Delhi riots conspiracy case is complete or not and if the prosecution was going to file any more chargesheets. .A division bench of Justices Suresh Kumar Kait and Manoj Jain asked Special Public Prosecutor (SPP) Amit Prasad to clarify the position on March 4.“You will make the statement and we will record it. You will tell us whether the fifth supplementary chargesheet is going to be filed or not,” Justice Kait said..The Court made the oral remark while hearing a bail plea by United Against Hate (UAH) founder Khalid Saifi, who is among those booked in the Delhi riots conspiracy case.Till now, five chargesheets have been filed in the case..The High Court today heard Senior Advocate Rebecca John for Saifi and SPP Prasad for the Delhi Police. The lawyers concluded their arguments in Saifi’s bail plea after which the Court adjourned the matter for further hearing till March 4 for clarifications. The Court also allowed the parties to submit the judgments they would want to rely on in support of their submissions. .Notably, some of the accused before the trial court have opposed the commencement of arguments on framing of charge in the case on the ground that the investigation is not yet complete in the matter and there is no clarity on when the same will conclude.The accused have said that if they start arguing the case without completion of the investigation, it would open their defence to the prosecution which could then file subsequent chargesheets bringing in new statements and evidence on record.
