The Delhi High Court on Monday dismissed a case for the removal of advocate Sanjeev Nasiar from the post of Vice Chairman on the Bar Council of Delhi (BCD) [Naresh Chand Gupta v Bar Council of Delhi & Ors]..Justice Sachin Datta dismissed the plea which alleged that Nasiar's law degree was fake and forged. The Court said that, at present, there was no basis to accede to the request for Nasiar's removal.“At present, however, there is no basis to accede to the prayers made by the petitioner in the present petition qua the respondent no.3 [Sanjeev Nasiar]. The petition qua the respondent no.3 is, therefore, dismissed,” the Court ordered.However, the Court ordered the BCD to send Nasiar’s documents and certificates to the Bar Council of India (BCI) which can conduct an inquiry and take action if any wrongdoing is found.“The BCD is, accordingly, directed to provide the requisite documents/ certificates/records to the BCI. Needless to say, it would be open for the BCI to conduct inquiry/take action, as it may deem appropriate, in any event of any wrongdoing being uncovered on the part of the concerned university,” the High Court directed. .The plea was filed by Naresh Chand Gupta, former President of the Delhi Bar Association, seeking a writ of quo warranto against Nasiar.Gupta claimed that Nasiar was enrolled with the BCD based on a forged and fabricated LLB degree.A direction was sought to the BCD and the BCI to strike off the names of Nasiar and another advocate Dalip Kumar Rana from the roll of advocates and file a first information report (FIR) against them for being allegedly involved in a “racket”.After considering the case, the Court dismissed the plea against Nasiar but ordered the BCI High Powered Committee to expeditiously conclude the verification of the degree/certificate of Rana’s enrolment as the BCD had already sent these documents to them..Advocate Rajiv Khosla, Surendra Singh Chauhan and Gaurav Singh appeared for petitioner Naresh Chand Gupta.BCD was represented by advocates Sanjeev Sagar, Nazia Parveen and Ajay Kumar Aggarwal.
