Delhi High Court rejects PIL challenging Centre's move to observe Samvidhaan Hatya Divas

The PIL was filed by one Samir Malik arguing that the Emergency was proclaimed under Article 352 of the Constitution and therefore, it cannot be said that it was done by murdering the Constitution.

The Delhi High Court on Friday rejected a public interest litigation (PIL) petition that challenged the Central government's notification to observe June 25 as Samvidhaan Hatya Divas to pay tribute to those who suffered and fought against the National Emergency imposed in 1975 by the Government of India.
