The Rules will replace 1967 Rules on the subject and will come into force on March 1, 2018..The Rules have been framed pursuant to a suo motu case initiated by the Supreme Court..The Supreme had initiated the case to work out a mechanism to dispose of long pending civil suits in different High Courts. It had first sought the response of Delhi High Court for the same..Initially, the Delhi High Court had contemplated amendments to the existing Delhi High Court Original Side Rules and Practice Directions. Subsequently, in a periodical report submitted by the Registrar General of High Court, it was informed that instead of amendments to the existing Rules, the Court would frame of a new set of Rules to comprehensively deal with the situation..On January 9, Senior Advocate Harish Salve appeared for the High Court and submitted that as the present case was not an adversarial litigation, he would be assisting the Supreme Court in evolving ways and means to ensure timely and expeditious disposal of civil suits by the Delhi High Court, particularly those involving commercial disputes..The new Rules which were framed by the High Court and approved by the Full Court were also placed before the Supreme Court on that day..The Court had taken note of the submissions and recorded the same in its order, before adjourning the case for March 13..Read the Delhi High Court (Original Side) Rules, 2018 below.
