The Delhi High Court recently passed a John Doe order restraining all unknown persons from infringing and misusing the name and trademarks of law firm Shardul Amarchand Mangaldas & Co [Shardul Amarchand Mangaldas & Co v John Doe & Ors]..In an order passed on August 7, Justice Mini Pushkarna also restrained the infringers from using the name or image of firm’s Executive Chairman Dr Shardul S Shroff or any of its partners/ members.John Doe orders are blanket cease and desist injunctions that are issued against anonymous entities. They are usually passed in suits involving infringement of intellectual property rights since it is often practically impossible to track down every infringing party.The Court ordered Google to block fake email IDs and reveal details such as phone numbers associated with them.The Central government was ordered to issue orders for blocking of phone numbers.“The plaintiff [Shardul Amarchand Mangaldas] is granted liberty to publish a Public Notice informing the general public, about the fact of the various false communications being issued by unknown persons, thereby, using and infringing the registered trademark, logo, trade name and names of representatives of the plaintiff firm, and also the fact regarding the filing of the present suit,” the Court said..Shardul Amarchand Mangaldas approached the High court over the misuse of its name and trademarks and the name of Dr Shroff and other intellectual properties.It was stated that unknown persons were using the firm’s name, logo and Dr Shroff’s image to send legal notices, emails and letters to people and were extracting money.The Court was informed that there may be a larger group of people involved in these illegal activities which could damage the goodwill and reputation of the firm as a whole..Shardul Amarchand Mangaldas warns public against fake legal notices using its name and impersonating Shardul Shroff.Senior Advocate Jayant Mehta and advocate Dushyant Manocha appeared for Shardul Amarchand Mangaldas and Co. .[Read Order]
