The Delhi High Court is set to consider laying down a policy to deal with the property of children who have lost both of their parents. [Master G Through Guardian & Anr versus State (NCT Of Delhi), Home Department & Anr].Justice Subramonium Prasad recently appointed Senior Advocate Dayan Krishnan as an amicus curiae in one such case and requested him to assist the Court by giving his inputs to "lay down a policy in cases” of such nature.The Court was hearing a petition filed by two children whose father killed their mother in September last year and then himself died by suicide. The children have been put up at Udayan Ghar for Boys by the Child Welfare Committee..While the relatives of the children had expressed their willingness to take them in, they refused to go with the relatives. In a petition filed through the children’s home, the children submitted that the properties belonging to their parents were being frittered away.Therefore, there was no other alternative but to approach the Court and invoke its parens patriae jurisdiction to secure the interest of the children, the Court was told. .The Court has now sought the response of the Delhi government on the children’s plea and said that replies should be filed within two weeks.
