The Delhi High Court has issued an advisory to all the judicial officers dealing with criminal matters, directing them to record the evidence themselves and not delegate the responsibility to their clerks..Acting Chief Justice Gita Mittal issued the advisory on the recommendation of the Rules Committee under Section 477 of the CrPC and all other Criminal Statutes and Jurisdictions..The issue had come to light during the hearing of a suo moto writ petition “In Re: To issue certain guidelines regarding inadequacies and deficiencies in Criminal Trials” in the Supreme Court wherein Senior Advocate R Basant had submitted that,.“The pernicious practice of the trial judge leaving the recording of deposition to the clerk concerned and recording of evidence going on in more than one case in the same court room at the same time under the presence and supervision of the presiding officer has to be disapproved strongly and discontinued forthwith. .A visit to the Delhi Trial Courts any day will reveal this sad state of affairs.” .The Acting Chief Justice while deprecating this practice, directed all the Judicial Officers to get the evidence recorded themselves and stated that the Court will take a serious view of any aberration..Read the Advisory
