Delhi HC transfers all commercial suits valued at less than Rs. 2 crore to District Courts

In view of the Commercial Courts, Commercial Division and Appellate Division of High Courts (Amendment) Act 2018, the Delhi High Court has transferred all commercial suits valued at or below Rs. 2 crore pending before it to the respective District Courts..The direction is applicable to suits filed on or after May 3, 2018..The said amendment in the Commercial Courts Act has reduced the pecuniary jurisdiction of the Delhi High Court by altering the ‘specified value’ from Rs. 1 crore to Rs. 3 lakh..“The Commercial suits pending in this High Court with a value of Rs Two Crore or less on or after 3rd May, 2018, excepting those which have been specifically ordered and/or liable to be tried by this Court, may be transferred to the respective district courts”, the High Court has notified..The announcement was made in a Circular issued by the Delhi High Court yesterday..For a formal order of transfer, such cases will be listed before the Joint Registrar (Judicial) in the days to come..As per the a note published in the cause list for January 31, 2018, such listing would begin from February 11 this year. The note reads,.“Counsel/Parties are informed that in view of the amendment in the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts (Amendment) Act, 2018 thereby altering the specified value from rupees one crore to rupees three lakh and Section 19 thereof, the commercial suits pending in this Court with a value of rupees two crores or less filed on or after 3rd May, 2018, excepting those which have been specifically ordered and/or liable to be tried by this Court, shall be transferred to the respective districts courts w.e.f. 11.02.2019.”.Read the circular:
