Delhi HC directs Police Commissioner to examine allegation of collusion between officials of three Police Stations

The Delhi High Court has directed the Commissioner of Police to “personally examine” a plea alleging collusion between the officials of three Police Stations in Delhi after they entertained over hundred complaints against the Petitioner’s family, which resulted in FIRs, and filing of charge-sheet without proper investigation..A single Judge Bench of Justice Mukta Gupta has asked Commissioner of Police to “take remedial action as warranted” in the matter before the next date of hearing..The case pertains to two petitions seeking to quash two FIRs registered against the Petitioner pursuant to the complaint of one Mukesh and another by one, Krishna at PS Fatehpur Puri..It is the Petitioner’s case that at least four FIRs have been registered against his family members wherein similar allegations have been levelled and the family members have been implicated..The Court recorded that Krishna who is the wife of one Kiran Singh has lodged 10 complaints with PS Fatehpur Beri. Kiran Singh himself has lodged 45 complaints in PS Fatehpur Beri and 22 in PS Mehrauli while his brother has lodged 1 complaint in PS Fatehpur..Furthermore, an associate of Kiran Singh has lodged 102 complaints in PS Fatehpur Beri, 132 complaints in PS Mehrauli and 59 complaints in PS Malviya Nagar..Additionally, 26 complaints in PS Fatehpur Beri and 34 complaints in PS Mehrauli were also lodged by one of Kiran Singh’s associates..The Court has recorded that a perusal of most of the complaint shows a similar pattern of allegations..Challenging the modus-operandi of lodging these allegedly false complaints, the Petitioner has sought for re-investigation in the two impugned FIRs as well as a direction to set up a Special Investigation Team to investigate the collusion between the officials of the three Police Stations..The Petitioner has also alleged that in one of the impugned FIRs, wherein he was not made to join the investigation even once, he was been charge-sheeted merely on the statement of the complainant. It is further claimed the Petitioner came to know about it only after summons were issued to him by the Trial Court..The Court has issued notice to the Delhi Police and asked the Commissioner of Police to file his response to the plea. Meanwhile, the hearing of trials in charge-sheets filed pursuant to the two impugned FIRs have been stayed by the Court..The matter would be next heard on January 14..The Petitioner was represented by Senior Advocate Sidharth Aggarwal with Advocate Arjun Dewan, Jhanvi Dubey and Uday Bedi..State Police was represented by Standing Counsel Rahul Mehra..Read the order:
