The Delhi High Court yesterday issued notice to the Union Ministry of Minority Affairs in a plea seeking quashing of certain guidelines of the new Haj Policy, which allegedly debars people with disabilities from applying for the Haj pilgrimage..The petition filed by Advocate Gaurav Kumar Bansal states that the guidelines are discriminatory, arbitrary and violate Articles 14, 21 and 25 of the Constitution, and are also inconsistent with the provisions of the Rights of Persons with Disabilities Act..It is stated that last year, the Ministry of Minority Affairs brought in a new Haj Policy, which debarred people who are physically incapacitated or are suffering from any kind of mental disorder, from applying for the pilgrimage..The petition states that,.“The impugned circular is in utter violation of the very right of the disabled and it can be compounded as discrimination by the state against the disabled.” .The Division Bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar issued notice to the Ministry of Minority Affairs, as well as with the Haj Committee of India and sought their response..Read Petition:
