The Delhi High Court on Tuesday took cognizance of a complaint against the Delhi High Court Legal Service Committee (DHCLSC) and issued notice to DHCLSC..The complaint made by advocate Vibhas Kumar Jha and addressed to the Acting Chief Justice of the Delhi High Court Gita Mittal, alleges manipulation in the final result of the Jail Visiting Panel advocates..Jha contends that the appointment of jail visiting advocates and criminal panel advocates result dated January 25, 2018 was manipulated since it differs from the result as announced on September 8, 2017..He has alleged that the Secretary with the approval of the Chairman of the DHCLSC changed the results and included names of fresh candidates in the result published on January 25 this year..“The final result were published with some manipulation in the list which prima facie looked in the name of advocates whose name were not in the interview list of jail visiting advocates. For example (if some one applied for judges but not selected for judges, they were appointed as peon on the recommendation of some high profile persons).”.The complaint also highlights certain inconsistencies in the manner in which the DHCLSC appointed its panel of jail visiting lawyers twice in the year 2015..“..the respondent had appointed some advocates without any advertisement and included in the list of jail visiting advocates vide order no. HC- 172/DHCLSC/Admn/JV/2015/726-736 dated 09.07.2015 which is clearly a violation of principles of natural justice..After one month again the respondent had appointed some more advocates without any advertisement and inserted in the list of jail visiting advocates vide order no.HC172/DHCLSC/Admn/JV/2015-937-947 dated 12.08.2015″.Jha has contended that it is arbitrary and violative of the principle of natural justice to select a panel advocates who have not applied for the said examination..He has also questioned the wisdom of including advocates, who were previously on the panel of interviewers for selecting candidates for the jail visit panel, in the criminal panel advocates..Jha in his complaint has prayed for an inquiry into the allegations and has also sought quashing of the final result published on January 25 this year..The matter was heard by Justice Vibhu Bakhru, who issued notice to the DHCLSC.
