Courts can consider anticipatory bail plea under Section 438 CrPC moved by accused who is abroad: Kerala High Court

"Mere fact that accused happens to be in a foreign country at the time of filing pre-arrest bail plea under S.438 CrPC is not a ground to hold that such an applicant cannot legally maintain his plea," the Court said.

The Kerala High Court recently held that anticipatory bail pleas moved by persons who are outside the country, can be entertained by courts in exercise of the discretionary powers conferred on it under Section 438 of the Code of Criminal Procedure (CrPC) [Anu Mathew v State of Kerala] [Mohammed Anees v State of Kerala].
