The Central government has asked the Law Commission to “examine” the implementation of Uniform Civil Code, reports The Economic Times..As per the report, the Ministry of Law and Justice has written to the Law Commission seeking a detailed report on the subject..Though Article 44 of the Constitution states that the State shall “endeavour” to legislate “a uniform civil code”, the said Article falls within the Directive Principles of State Policy, and hence not enforceable. The non-implementation of a uniform code has been the subject of much political debate..Interestingly, the Supreme Court is currently seized of a case concerning personal law of Muslims wherein it will decide on the Constitutionality of the muslim practices of triple talaq and polygamy..This case is likely to be heard by a Constitution Bench of the apex court. The Centre has not yet filed its response in the case.
