There is a pressing need to control and regulate the spread of deepfakes on internet, the Delhi High Court said on Wednesday..A Division Bench of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela remarked that people today cannot be certain about the authenticity of what they are seeing and hearing through their own eyes and ears is.“Today what you are seeing and hearing you can’t believe. What I am seeing through my eyes and hearing through my ears, I can’t believe. This is something which is truly shocking. Everything that you are seeing or hearing is fake. It can’t be,” the Bench said.The Court also said that it may not be correct to categorise deepfake generating platforms as intermediaries under the information technology laws.Acting Chief Justice Manmohan told the Central government that deepfakes are going to be a menace to society and the government must start working to regulate them..The Court made these observations while dealing with two petitions filed by journalist Rajat Sharma and advocate Chaitanya Rohilla seeking regulation of deepfakes.Additional Solicitor General (ASG) Chetan Sharma appeared for the Central government and told the Bench that this is a malaise.Sharma added that the antidote to fake AI can only be a counter-technology..The Court considered the reply filed by the Central government in the case and asked the petitioners to give their suggestions to regulate the technology.The Court asked the petitioner to study the laws introduced by the European Union, United States as well as the Elvis Act of the State of Tennessee in the US, and file an affidavit.The case will be heard next in October.
