The bail hearing of Dayanidhi Maran will take place today in the Supreme Court before a three-judge bench comprising Justices TS Thakur, V Gopala Gowda and R Banumathi..Senior Advocate Abhishek Manu Singhvi, who mentioned the matter in the Supreme Court yesterday, is also expected to represent Maran today..Nearly two months ago, Maran had moved the Madras High Court for anticipatory bail in case relating to his time as Union Minister. The High Court has granted him bail. Subsequently the CBI sought cancellation of the bail contending that Maran was not co-operating with the investigation..Justice S Vaidhyanathan of the Madras High Court in his order, had cancelled the interim anticipatory bail. Senior Advocates ARL Sundaresan and PS Raman had argued for Maran while ASG G Rajagopalan, representing the CBI, had opposed it..The charge against Dayanidhi Maran.“The sum and substance of the prosecution case is that the petitioner (Dayanidhi Maran), while he was a Union Minister, during the period 2004-2007, abusing his official position and in collusion with the officials of BSNL, Chennai, and in furtherance of conspiracy with dishonest intention, got installed more than 300 telephone connections with ISDN-PRA and ISDNBRA, Lease Circuit facilities, 19 post paid mobile connections etc., in his residence in the name of the accused Government servants to show these connections illegally under ‘service category’, thereby no payment was made for the installation and rentals. .Further, by not generating any users bill during the said period, misappropriated huge amount which was to be paid to the Government, thereby caused huge wrongful loss to the Government, to the tune of Rs.1,20,87,769/- and the corresponding gain to himself and others..The petitioner [Dayanidhi Maran] had also obtained 19 prepaid mobile SIM cards under service category illegally, without his entitlement from BSNL, Chennai and these SIM cars were used by the staff of SUN TV without payments of due charges to BSNL”..Why did the Madras High Court cancel Maran’s bail?.It is the CBI’s stance that Maran gave evasive answers when examined by the CBI, retracting from his earlier version, and chose not to furnish any relevant information..Maran’s case.Maran’s contention is that there was only one ISDN-PRA connection and not 300 as alleged. He further claims that the CBI wanted to force a confession from him. His refusal to confess prompted the CBI to level allegations of “evasive answers” and “non-cooperation” ..Today in the Supreme Court.The case is listed as item 1 in court room 2.
