The Mumbai Sessions Court will pronounce its verdict in the bail plea filed by Vishal Jha, accused in the Bulli Bai case, on February 5, 2022..The 21-year-old engineering student from Bengaluru was the first person to be arrested in the case. He was arrested from Bangalore, remanded to police custody and then sent to judicial custody after he contracted COVID.Soon after, he moved for bail, which was rejected by the Magistrate Court.The very next day, Jha approached the Sessions Court for bail.After hearing to submissions of both sides at length, Additional Sessions Judge SJ Gharat reserved the plea for orders..Jha has stated in his bail application that he was falsely implicated in the case and denied having committed any offence.Relying upon the Magistrate Court’s reasoning that Jha had technical knowledge of the subject, his lawyer, advocate Shivam Deshmukh argued if that had been the case, then he would never have surrendered before the investigating agency to show his willingness to co-operate.Deshmukh stated that prosecution had not alleged that Jha was one of the users of the twitter handles @bullibai, @ Sageox11, @hmmachaniceoki, @jattkhalsa7 and @wannabesigmaf who were allegedly involved in the case or was one of the creators of the Bulli Bai app.They also failed to make out a case that his alleged twitter account - @khalsa had been used to malign the image of the complainant or any other women, it was contended.He stated that the agency was already seized of his laptop, mobile phone and sim cards and, therefore, he was no more in a position to tamper with those articles which could be possible evidence.He further argued that the creator of the app was some other person who was already in the custody of the investigating agency and that Jha was in no manner associated or known to the other accused persons.Deshmukh informed the Court that Jha was an engineering student and excelled in academics..The prosecution opposed the application, arguing that since Jha had been shifted to the COVID centre for his treatment, he could not be confronted with the information on the devices.They stated that Jha had 6 Twitter, 2 Instagram, 1 YouTube and 6 Gmail accounts and a thorough investigation would be required. His account on the Github platform also requires investigation, it was submitted.They also alleged that Jha was a member of the Twitter groups ‘High IQ Bruh’ and ‘Trad Mahasabha’ where the link to the Bulli Bai App had been shared and they wanted to further probe if Jha along with the other accused had indulged in similar offences.From the investigation so far, the prosecution alleged that Jha was very active on social media groups and used to post material which could have provoked breach of peace.The prosecution also claimed to have been probing whether these accused in the Bulli Bai case were connected to the July 2021 Sulli Deals case.
