Breaking: Collegium has no hesitation in disclosing reasons for transfer of judges if necessary

The Supreme Court Secretary-General has issued a statement that the Supreme Court no hesitation in disclosing reasons for transfer of judges if found necessary.

The statement is in response to certain reports in the media regarding the transfer of Chief Justices/ judges of High Courts.

The statement begins as follows:

“Certain reports relating to recommendations recently made by the Collegium regarding transfer of Chief Justices/Judges of the High Courts have appeared in the media.”

The statement goes on to clarify that all recommendations for transfer made by it are done based on cogent reasons and after complying with the required procedure.

Though it is not in the interest of the institution to disclose reasons for such transfer, the Collegium will have no hesitation in disclosing such reasons if found necessary.

“As directed, it is stated that each of the recommendations for transfer was made for cogent reasons after complying with the required procedure in the interest of better administration of justice. Though it would not be in the interest of the institution to disclose the reasons for transfer, if found necessary, the Collegium will have no hesitation in disclosing the same.”

The statement goes on to say that each of the recommendations was made after full and complete deliberations and the same were unanimously agreed upon by the Collegium.

Recently, the Collegium had recommended the transfer of Madras High Court Chief Justice VK Tahilramani to the Meghalaya High Court.

While speculations were rife about the reasons for such a decision, Justice Tahilramani had resigned from office. The Madras Bar had boycotted courts for a day to express their solidarity with the judge.
