The transfer, or rather the stalling of Justice MR Shah‘s transfer from the Gujarat High Court has now reached the Supreme Court..A lawyer from Gujarat High Court has filed an intervention application in the case concerning appointment of judges..Senior Advocate Ram Jethmalani appeared for the petitioner lawyer..The case relating to appointment of judges was listed as item 1 before the Bench of Chief Justice TS Thakur and Justice Anil R Dave. However, it was passed over and the court began hearing other cases..However, the hearing was suddenly interjected by Senior Advocate Ram Jethmalani who said that he was appearing for a lawyer from the Gujarat Bar who wanted to intervene in the case relating to judges appointments..He submitted,.“Your lordships, this is about the judge against whom your lordships has made a remark in open court”..“Has he not been transferred?”, asked Justice Thakur..“No the situation is really bad”, replied Jethmalani..The court then allowed the intervention application though the main matter had been passed over..The main case was later taken up and adjourned after the court said that the Collegium stands by the 43 names which had been returned by the Central government..Justice MR Shah’s transfer has become a subject matter of discussion among Bar members, especially in Gujarat. It is alleged that the Central government was refusing to clear his transfer files so as to allow Shah J. to continue in Gujarat High Court..Senior Advocate Yatin Oza had written a scathing letter to the Chief Justice of India alleging that Justice Shah’s proximity to ruling dispensation was allowing him to continue in Gujarat High court. This resulted in Oza having to face a contempt of court case..Later, Chief Justice Thakur himself had made some strong remarks against the sitting judge and the Central government, stating that the Supreme Court will consider withdrawing judicial work from Justice Shah, if his transfer is stalled.
