Bombay HC directs Binoy Kodiyeri to undergo DNA test in Rape case

In a significant development, the Bombay High Court has directed Binoy Kodiyeri to undergo a DNA test in the petition moved by him to quash charges of rape filed against him..Binoy Kodiyeri is the son of Kerala CPI (M) Secretary Kodiyeri Balakrishnan. He had moved the High Court to quash the First Information Report (FIR) registered against him by a 32-year-old woman who had alleged that Kodiyeri had sexual relations with her on a false promise to marry her. Kodiyeri has been booked under Sections 376 (rape) and 420 (breach of trust and cheating) of the Indian Penal Code ( IPC)..On July 2, a Dindoshi sessions court granted anticipatory bail to Kodiyeri on strict conditions. The sessions court had directed that Kodiyeri should cooperate with police if they seek a DNA test to prove paternity. The court also specifically observed that he should not try to influence either the witnesses or the complainant..The sessions court further directed him to appear before the investigating officer every Monday and asked him to pay a security deposit of Rs 25,000..Earlier, Binoy had appeared before Oshiwara Police station and refused to give his blood samples for a DNA test claiming that the matter is pending before the high court..However, he informed the Bombay High Court today that he was ready for the DNA test.
