The case was pending before a trial court in Ayodhya.A Bench of Justice Jaspreet Singh granted conditional bail to the man."Considering the rival submissions as well as the facts and circumstances of the case and the material available on record also considering the nature of allegations and accusation against the applicant, the severity of the punishment if convicted and the period of incarceration as well as the fact that no apprehension has been expressed by the learned AGA that the applicant is at the risk of fleeing justice or that he would tamper with evidence or influence any witness, hence, at this stage, without expressing any opinion on the merits of the case, this Court is of the view that the applicant is entitled to be released on bail," the Court noted..As per the first information report (FIR), the applicant was taking care of the complainant's cow for several years. The complainant harbored suspicions regarding the applicant's behavior, alleging that the applicant engaged in unnatural sexual acts with the cattle. This was after some unknown persons forwarded a video to the complainant in that regard on July 30, 2023. It was in light of these circumstances that the FIR was filed..The petitioner's counsel argued that the accused was innocent and had been falsely implicated in the case. The accused, a senior citizen aged about 70 years, had no previous criminal history, he added.It was further argued that there was nothing on record indicating that the applicant was arrested based on the alleged video. The counsel contended that the applicant had been in jail since July 23, 2023, and thus was entitled to be released on bail.It was also urged that there is no possibility of the applicant of fleeing away after being released on bail or tampering with the witnesses.
