As per a Notice published by the Secretariat, Committee for Designation of Senior Advocate, 237 Advocates have applied for Senior Designation before the Delhi High Court..Pursuant to the Notice, the Committee has now sought suggestions/views, only if accompanied by verifiable materials, by stakeholders in terms of Rule 8 of the High Court of Delhi Designation of Senior Advocate Rules, 2018, within four weeks from October 1..Such suggestions/views can be submitted to the Committee within the stipulated time frame for the purpose of scrutiny and assessment..The Notice clarifies that no suggestions/views would be entertained after a period of four weeks from October 1..The applications for Senior Designation were called for pursuant to the newly notified High Court of Delhi Designation of Senior Advocate Rules, 2018. The deadline for submitting an application was May 25, 2019..Thereafter, a petition was filed challenging the Rule 7 of the Senior Designation Rules insofar as it called for a joint proposal by three Senior Advocates to recommend a lawyer for designation as a Senior Advocate..On May 15, the Delhi High Court stayed the operation of this Rule. A Division Bench of Chief Justice Rajendra Menon and Justice Anup J Bhambhani had thus allowed advocates to directly apply to the Committee for designation of Senior Advocates..On August 14, the High Court published a Public Notice stating that Rule 7 had been amended and the condition of a joint proposal by three Senior Advocates had been done away with..The amended Rule stood as follows:.“(7) Procedure for designation of an Advocate as Senior Advocate. An advocate may be considered by the High Court for being designated as Senior Advocate either (A) SuoMotu by the High Court. or (B) on an application by an Advocate..(A) Procedure Suo Motu:i. An Advocate who fulfils the eligibility conditions prescribed hereinbefore, may be considered suo moto by the High Court for being designated as a Senior Advocate either on the written proposal of a Judge of the High Court or of Hon’ble the Chief Justice of the High Court. ii. Such written proposal of a Judge or of Hon’ble the Chief Justice shall be sent to the Registrar General who shall forward it to the Secretariat after obtaining a consent-cum personal information sheet (Annexure-A to these Rules) duly filled in and signed by the Advocate concerned..7(B) Procedure on application by an Advocate:’ Any Advocate who fulfils the eligibility conditions prescribed he.reinbefore may submit a written application for being designated as Senior Advocate to the Registrar General who shall forward it to the Secretariat after obtaining a consent-cum-personal information sheet (Annexure-A to these Rules) duly filled in and signed by the Advocate concerned.”.In view of the amendment, the High Court afforded one more opportunity to advocates who are eligible and wish to apply for Senior gown to submit their applications and the deadline for application was extended till August 31. .Read the Notice:
