Monsanto v. Nuziveedu: Delhi HC holds Bt cotton seed to be unpatentableApril 13 2018
In a judgment that affects multiple fields including agriculture, pharmaceuticals and intellectual property, the Delhi High Court held Monsanto Technologies' patent claim on its Bt cotton seed varieties to be unenforceable in India.
Monsanto Technology LLC and Nuziveedu Seeds Ltd had entered into a sub-license agreement under which the former sold seeds to the latter. In turn, Nuziveedu had to pay royalties for the use of such donor seeds.
