Limited..Two orders, one of May 3 and the other May 31 reveal the controversial turn of events..Order of May 3 .This order divulges what transpired in Uttar Pradesh when the Local Commissioner appointed by Delhi High Court sought police assistance..As per the order, an application was filed under Order 39 Rule 2A read with Section 151 CPC on behalf of the plaintiff, Patanjali..The application states that the concerned Station House Officer not only refused to provide the Local Commissioner appointed by Delhi High Court with any police assistance, but also threatened him, even going to the extent of alleging that the order passed by the High Court, which was produced by the Local Commissioner, was a fabricated document..“In the present application, it has been averred that the Contemnor No.5/SHO along with police officials not only refused to provide the Local Commissioner appointed by this Court with any police assistance stating that the order dated 16th April, 2018 passed by this Court was a false and fabricated document, but the police officials and the Contemnor No. 8 also collectively threatened the Local Commissioner.”.The application by Patanjali also contained a report prepared by the Local Commissioner. Noting that the said report contained serious allegations against the alleged contemnors, the Court issued notice to the alleged contemnors of UP Police..Order of May 31.On May 31, the contemnors were personally present in court, when Justice Manmohan came down upon them in very strong words..The order passed on that day states,.“After hearing the contemnors at some length, this Court is of the prima facie view that they have still not appreciated the seriousness of the situation. It has been pointed out by this Court that by “threatening” the Local Commissioner, who is an agent of this Court, and by “not facilitating the execution of the commission”, the actions of the contemnors constitute an affront to the majesty of the Court and an interference with the administration of justice, besides being cognisable offences.”.The Court therefore ordered the contemnors to file reply affidavits while also seeking the personal presence of Inspector General of Police, Meerut Range, Uttar Pradesh on the next date of hearing..“The Inspector General of Police, Meerut Range, Uttar Pradesh, shall be personally present in Court on the next date of hearing along with contemnors No.5, 6, 7 and 8.
