The Supreme Court today refused to interfere with the Delhi High court order granting bail to Karti Chidambaram in the INX Media case..Last March, the Delhi High Court had allowed Karti Chidambaram’s bail application on a surety of Rs. 10 Lakh. This was challenged by the Central Bureau of Investigation (CBI) before the Supreme Court Bench of Justices AK Sikri and Ashok Bhushan..ASG Tushar Mehta, appearing for the CBI contended that when Karti approached the Delhi High Court for bail, a similar application was pending before the trial court. Mehta told the Court that the High court should not have entertained the application in such a case..Senior counsel and Congress leader Kapil Sibal submitted that there is a judgement of the Court which says “there is concurrent jurisdiction and this concurrent jurisdiction can be invoked“..Not commenting on the subject, the Court took the submissions on record and went on to say that the Court was not inclined to interfere with the Delhi High Court order..While dictating the order, Justice Sikri said that the question of law on whether Karti could approach the High Court when his bail application was pending before the trial Court, would be kept open..The Court also made it clear that the observations made by the Delhi High Court in the bail matter will not affect any other proceedings.
