The conversion and subsequent wedding of a 24-year old from a sleepy village in Kerala has captured the attention of the entire country..The case, which is now in Supreme Court, has become a keenly watched battle in political circles as well since the ramifications could be huge..Since, the stakes involved are high, both sides have upped the ante in the Supreme Court..After Senior Advocate Dushyant Dave’s outburst last week and the observations by the Bench on dissolution of marriage by the Kerala High Court, the matter is coming up for hearing in Court tomorrow..Interestingly, the officers of Kerala Police, who investigated the case have filed an additional affidavit in the matter while Hadiya’s father Asokan has filed an interim application..The contents of the two documents make for an interesting read. Below are the excerpts..Affidavit by Kerala Police.Kerala Police had initially conducted investigation in the case as per the directions of the Kerala High Court..Now the Additional Chief Secretary of the Home Department of the State has filed an affidavit on behalf of the concerned police officers who conducted the investigation..The police officers have claimed that the investigation was conducted in an efficient and sincere manner and the investigation did not reveal commission of any scheduled offence that required to be reported to the Central government under the National Investigation Agency Act, 2008..The affidavit also sets out the various aspects, which were probed by the Kerala police before the investigation was handed over to the National Investigation Agency, by the Supreme Court..Application by Hadiya’s father Asokan.Meanwhile Hadiya’s father Asokan has filed a lengthy interim application seeking a direction to be issued to NIA to complete the investigation expeditiously..Asokan, in his affidavit, has made a slew of allegations including against Islamic organisations outfits, PFI and SDPI and Hadiya’s husband, Shafin Jahan (the appellant in the case)..Citing the High Court decision, Asokan has stated,.“The High Court has described the petitioner as a stooge acting on behalf of the forces behind the curtains and he was brought in at the eleventh hour after a rushed marriage only to defeat the orders of the court and take Akhila out of the country…..the petitioner, who has been in touch with ISIS agents including one Mansi Buraquiwho, carries out recruitment for ISIS in India, was admitted trying to take Akhila out of the country to the middle-east…It is not a mere co-incidence that around the same time, several neo converts have escaped to ISIS controlled territory. It is pertinent to note that till June 2016, around 21 youths from Kerala have gone missing and are feared to have joined ISIS.”.The application then goes on to cite cases of five other girls, which allegedly reveal a “pattern similar to the conversion/indoctrination” of Hadiya/ Akhila..Alleging that the nature of brain washing and indoctrination is “uncannily similar” in all the cases including that of Hadiya, Asokan submits,.“….all of these educated young women have been speaking in the same voice showing extreme fears of horrors of hell…Akhila too has been made to believe that the only escape from hell is the path shown by such extremists/ radicals.”.Asokan has further made a series of allegations against SDPI and PFI alleging that the two organisations are involved in extremists activities and radicalization of youth with affiliations to ISIS, Lashkar-e-Taiba, Hizbul Mujahideen etc..He has also cited various cases pending against members of the said organisations..Asokan has prayed for an expeditious investigation by NIA into the matter and also prayed for a direction to ensure protection and safety of Hadiya, her mother and himself..The case is slated for hearing tomorrow before a Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud as item 8..Read Asokan’s application below. .
