Habeas Corpus plea filed by Dr. Suyash Gupta’s mother in Delhi HC

A petition praying for a writ of Habeas Corpus has been filed in the Delhi High Court by the mother of Dr. Suyash Gupta who has been missing since August 24. Dr. Suyash Gupta is the prime suspect involved in the death of fellow doctor Shashwat Pande..The petitioner Vandana Gupta and her husband reached the Police Station on August 25, where they were informed that their son was involved in an altercation with the deceased..The petition filed through Advocate Jayant Bhatt states that,.“Upon reaching the Police Station, the phone of the petitioner was taken away by the police and the whereabouts of her husband, daughter, son and other family members was inquired..The petitioner from the date of the incident until the coming week was under strict police surveillance inside her house.” .It is further stated that the grievance of the petitioner is that of a mother who is worried and anxious about her son’s illegal and unlawful detention and whether he is even alive..It is argued that even after months of investigation and interrogation, the police have failed to ascertain the whereabouts of the petitioner’s son..The petitioner has also stated that she has constantly co-operated with the police as and when required but she feels that there has been a serious dereliction of duty by the police officials in the investigation..It is also mentioned that the petitioner and her husband were called to the hospital, where Dr. Suyush worked, and were told that their son was bisexual. It is further mentioned that the deceased and the petitioner’s son were in fact having a secret relationship..The petitioner submitted that,.“Dr. Gupta (petitioner’s son) has been subjected to regular discrimination by the hospital and its staff making him a scapegoat or an easy target for their vested interest.” .It is also alleged that the petitioner’s son was given medication by the Hospital, which were adverse in nature and had severe side effects which resulted in the mental and physical dullness of the petitioner’s son over a period of time..The petitioner has prayed that a writ of Habeas Corpus be issued to the State “to ensure that the son of the petitioner is not illegally or unlawfully detained” at the premises of St. Stephen’s Hospital. The petitioner has also sought CDR details and CCTV footage to ascertain the last known whereabouts of her son..Further, the petitioner has prayed for an SIT probe into the whole episode..The Division Bench of Justices S Muralidhar and IS Mehta asked if the petitioner and her husband were willing to join the investigation.
