After the initial attempts to contact Rainmaker failed, a mail was sent to the CEO Mr. Nikhil Chandra. As a reply to our mail, Mr. Chandra directed the questions towards the BCI for any clarifications..Mail sent to Nikhil Chandra: “The RTI application filed by me, has revealed that, from the total funds generated through the three Bar Exams is Rs. 6,98,23300. Out of which Rs. 4,84,46900 has been given to Rainmaker for conducting the exam and the rest has been retained by BCI. These figures reveal that around 70% of the total revenue generated has been given to Rainmaker for conducting the examinations. Earlier, it was indicated by the Bar Council of India, that an equal distribution of the aforementioned funds among the BCI, Rainmaker and the State Bar Councils would be done. I would be very grateful if you could let me know the reasons for this deviation in sharing of the income received.”.Reply received: “Thanks for your email. As a policy we do not comment on any matters with respect to the AIBE and I would request you to reach out to the BCI for any clarifications that you require. Trust you appreciate our position.”.After consistent efforts to contact the BCI officials via email failed, a call was made to BCI Chairman Mr. Manan Kumar Mishra. However, he declined to comment on the issue any further and stated that the contract with Rainmaker has been terminated..Some clarifications subsequent to the publication of this story have been brought to our notice, which indicate the contractual status between the BCI and Rainmaker..While the BCI had initially announced that the revenues generated through AIBE will be equally divided between the BCI, the state bar-councils and Rainmaker; however the MoU signed between BCI and Rainmaker provides that the share of Rainmaker will be 70%..Bar & Bench carried a news report based on the earlier plans of the BCI as early as June 2010. However, later in March 2011, former BCI Chairman Gopal Subramanium confirmed that a MoU between Rainmaker and BCI has been signed wherein Rainmaker would receive Rs. 900 out of the Rs. 1,300 bar exam fee paid by each examinee. This was reported by Legally India here..We regret the error made in our previous story and hence this clarification.
