The Supreme Court today adjourned the hearing in the petition filed by Malayalam film actor Dileep in relation to the sexual assault case he has been implicated in..Dileep, who was represented by Senior Counsel Mukul Rohatgi, has filed a petition before the Supreme Court after his plea to access the memory card that contains video footage of the alleged assault was turned down by the Kerala High Court..Rohatgi argued before the Court that considering the memory card is part of the police records, his client has a right to be supplied with the same, along with a copy of the police reports under Section 207 of the Code of Criminal Procedure (CrPC)..A memory card containing video footage of the assault was handed over to the Magistrate by the lawyer of one of the accused. This was done considering that the original mobile device used to film the assault was not recoverable..It is Dileep’s case that the video contained in the memory card is fabricated and is a compendium of shorter clips as opposed to a 3-4 minute long sequence, as is mentioned in the police records..The said memory card was not supplied to the accused on the grounds that it is not a “document” under the provisions of the law. The High Court had also stated that the contents of the memory card are too sensitive to be released..Today, the Apex Court Bench of Justices AM Khanwilkar and Hemant Gupta agreed that the video of the alleged assault was too sensitive to be let out. It noted that the provisions of the Information Technology Act will also have to be considered..Rohatgi sought time to prove that the memory card is a document under Section 207 CrPC..The Court then adjourned the matter until December 11..Dileep was charged under Sections 120(B), 342, 366, 376(D), 411, 506(1), 201, 212 & 34 of the Indian Penal Code and sections 66 (E) & 67(A) of the Information Technology Act..The investigation pointed out that Dileep had allegedly set the wheels of a revenge crime in motion against the victim, also a noted actor in the Kerala film industry. It was alleged that the victim had a role to play in Dileep’s separation from his former wife. Further, Dileep faced allegations of hatching a conspiracy to take revenge on the victim by orchestrating an abduction of the actress and taking nude photographs of her..Six persons were nabbed and arrayed as accused after the female actor was driven around in a car and sexually assaulted, allegedly at Dileep’s behest..Dileep was then arrested on July 10, charged with engaging the first accused to take nude photos of the victim, in exchange for Rs. 1.5 crore.
