Delhi HC notice in Petition alleging irregularities in conduct of DU LLB Entrance Exam 2018

The Delhi High Court has issued notice in a petition filed against the alleged irregularities in the LL.B entrance exam conducted by the Faculty of Law, Delhi University (DU) this year..The Bench also stated that that the admission process for the upcoming session in the LL.B course would be subject to the outcome of the petition..The writ petition has been preferred by an aggrieved candidate, who claims that “illegalities and irregularities” which marked the conduct of the exam this year violated Articles 14, 19 and 21 of the Constitution..In particular, the petitioner raises issue with the Computer Based Test (CBT) system used by DU to conduct the LL.B entrance examination..This is the first time that a Computer Based Test was conducted by DU for admission to the course. In light of the experience undergone by the petitioner during the test, he has submitted,.“The entire process and procedure adopted by Delhi University lacks fairness and transparency.”.It is the petitioner’s case that the computer systems did not record the choices marked by the petitioner which led to a much lower score in the entrance examination. He also states that the examination centres suffered from multiple power failures at the time of the examination..The petitioner has, therefore, sought for an additional 14 marks which he estimates to have lost in the entrance exam and permission to participate in the second round of counselling..The petitioner also seeks a direction to the Faculty of Law, DU to supply a copy of the answer sheet to the candidates on the date of the examination itself from 2019-2020 onwards..The petition further calls for an audit of the CBT system used for the entrance examination by Centre for Development of Advanced Computing (C-DAC), New Delhi or any other Government or Government approved IT company..To look into the irregularities which took place in this year’s exam, the petitioner has also prayed for the constitution of an independent committee comprising legal and technological experts and headed by a retired High Court judge..The petitioner is represented by advocates Setu Niket and Esha Mazumdar..The matter will be heard next on September 7, 2018.
