The Delhi High Court today issued notice to the Ministry of Human Resource Development and Ministry of Law seeking uniform education syllabus for all children aged 6-14 years in India..The matter was heard by a Bench of Chief Justice G Rohini and Justice Jayant Nath in a public interest litigation filed by advocate Ashwini Kumar Upadhyay..Upadhyay, in his petition has stated that the petition is filed for the development of the socially and economically down trodden people of the country and for ameliorating their conditions..He has submitted that discrimination in quality of education violates Articles 14 and 15 of the Constitution..“Right to Education under the Article 21A has to be read in conformity with Article 14 and 15 of the Constitution. There must be no discrimination in quality of education. The right of a child should not be restricted only to free and compulsory education, but should be extended to have equal quality education without any discrimination on the ground of a child’s social economic and cultural background thus a common syllabus and common curriculum is required.”.He has contended that the State should provide not just free and compulsory education but also value-based uniform education..“Right to Free and Compulsory Education Act 2009, is considered a giant leap towards universalisation of education in India. State should provide not only free and compulsory education but also value-based uniform education having common syllabus and common curriculum to all children of the age of 6 to 14 years in spirit of the Article 21A read with Article 14 and 15”, states the petition..Based on the above grounds, Upadhyay has prayed for direction to be issued to the Union government to provide Uniform Education having Common Syllabus and Common Curriculum to all the Children aged 6-14 years throughout the territory of India..Upadhyay has also sought for “an authoritative textbook on ‘Environment, Health and Safety’, a standard textbook on ‘Socialism, Secularism and Nationalism’ and a reliable textbook ‘Aims and Objectives of the Constitution’ having chapters on Fundamental Rights, Fundamental Duties, Directives Principles and the Golden Goals as set out in the Preamble of the Constitution for all the children aged 6-14 years.”.Earlier, the Supreme Court had issued notice in a petition filed by Upadhyay seeking directions to double the number of judges in the country.
