Delhi HC directs Hush app to take down content on Ola Cabs

The Delhi High Court has directed ‘Hush’, a web-based platform to remove content that either reveals confidential business information of ANI Technologies run Ola Cabs or disparages the reputation of the online cab aggregator or its employees..The Court also directed the platform to produce the names and addresses of the persons who had posted the impugned content on the Hush app, in a sealed cover on the next date of hearing..Hush app enables one to anonymously discuss and post work-related content on its platform..Justice Jayant Nath passed the ex parte injunction in a suit filed by ANI Technologies Pvt. Ltd seeking a permanent injunction against the publication of any confidential business information or disparaging comments on the Hush app..After going through the impugned content posted on the Hush app, Justice Nath observed that,.“A perusal of the contents of the documents would show that some of them so reveal confidential business information of the Plaintiff and are disparaging to the Plaintiff/its employees.”.The Court, therefore, directed:.“Defendant no. 1 will remove the information which is uploaded in the app on receipt of a certificate from the Plaintiff certifying that the information as contained in the app or a particular post either contains confidential business information of the Plaintiff or is disparaging to the Plaintiff/Plaintiff’s employees.”.ANI Technologies was represented by Senior Advocate Rajiv Nayyar, briefed by JSA lawyers Dheeraj Nair, Manish Jha and Kunal Chaturvedi..Read order:
