Delhi Court reserves order in Shashi Tharoor’s plea to bring tweets by Sunanda Pushkar on record

A Delhi Court presided by Special Judge Ajay Kumar Kuhar today reserved its order in an application moved by Shashi Tharoor to bring on record the tweets posted by Sunanda Pushkar through her Twitter handle..The application by filed Shashi Tharoor was moved in the case pertaining to the mysterious death of Pushkar in January 2014..In August this year, the Delhi Police had pressed for framing of charges under Sections 498A and 306 or alternatively under Section 302 of the Indian Penal Code against Tharoor..The Court is presently hearing arguments on framing of charges against Tharoor..It is Tharoor’s case that Pushkar’s Twitter timeline ought to be brought on record and made part of the case material in order to ascertain her state of mind before her death as it would have a “crucial bearing” on the issue of his discharge or framing of charge..During the course of arguments, counsel for Tharoor, Senior Advocate Vikas Pahwa, had specifically referred to certain tweets which were made by Pushkar on January 17, 2014 at 4.46 am as well as on January 16, 2014, i.e. hours before her death..In her January 16 tweet, Pushkar had released a joint statement with her husband to claim that “they were very happily married and intended to remain that way.” The statement also informed that Pushkar was ill and seeking rest. In the January 17 tweet as well, Pushkar had come out in defence of her husband in connection with the Mehr Tarar controversy..The application thus asserted that the tweets indicated that Pushkar was not having any “suicidal ideations”, and was rather she was in a positive frame of mind with respect to her relationship with Tharoor..Opposing the request to bring Pushkar’s tweets on record, the Delhi Police today argued that the application was vague and was an effort to stall the trial in the case..Delhi Police, which is being represented by Public Prosecutor Atul Srivastava, also submitted that it has no record related to Pushkar’s tweets..Sunanda Pushkar was found dead in her suite at a five-star hotel situated in New Delhi on January 17, 2014. Pushkar’s husband and Congress leader Shashi Tharoor, who is the sole accused in the case, is presently on bail..As per the prosecution, Pushkar was a completely healthy person and the cause of her death was poisoning due to the consumption of Alprazolam..The prosecution’s case is based on the ground that Pushkar was subjected to mental cruelty by her husband due to several controversies surrounding their relationship..The order will be pronounced on December 12..On the last date of hearing, Tharoor had submitted that the cause of her death has not been established by the Delhi Police in the chargesheet.
