Court in its administrative capacity is "State" under Article 12, Bombay High CourtMay 5 2018
The Bombay High Court has ruled that Courts and Court establishments in their administrative capacity fall within the definition of “State” under Article 12 of the Constitution.
However, the High Court also unambiguously stated that on the judicial side, courts are completely independent and do not fall within the scope of Article 12.
