Yeddyurappa and mining tycoon and former minister in Yeddyurappa’s cabinet, G. Janardhana Reddy against CBI while he is special CBI counsel in 2G scam. Lalit appeared for them on the day when his presence for 2G trial was crucial, reports DNA..Earlier too, a controversy had erupted when Lalit represented Suresh Kalmadi in CWG scam and appeared against CBI. Lalit told HT, “I have been advising Kalmadi for four months…I was asked to represent the CBI in the 2G case only subsequently. I’m not a general counsel for the CBI and am only bound by the Supreme Court’s directions in 2G cases. 2G and CWG cases are not connected. A special public prosecutor is not barred from taking up independent cases and so there is no conflict of interest also”..There was an initial reluctance too when Lalit was appointed as Special Counsel in 2G scam as he was already appearing for Hasan Ali khan, the Pune businessman, accused of money laundering..There definitely seems to be some conflict of interest as he is a special CBI counsel in 2G scam and in all other matters he is appearing against CBI which definitely raises doubts in the mind of common man regarding the independence of CBI in fighting against corruption..DNA reports, G.R. Mohan, an advocate practising in the Karnataka high court has shot off a letter to the court’s chief justice, stating that Lalit “has violated the conditions subject to which he was appointed as a prosecutor in the 2G trial”. The two-page-complaint also states that “the Hon’ble Supreme Court… had stipulated that a prosecutor… would have to free himself of various other (legal) obligations so as to make himself thoroughly available to conduct the 2G trial”..Many other legal experts, including a few former judges, agree with this position and state that Lalit should avoid attending these cases on moral and ethical grounds and in public interest to ensure that the common man does not lose trust in the CBI and its bid to fight corruption.
