Collegium Resolutions: Five recommended for elevation to Madhya Pradesh High Court

The three senior most judges of the Supreme Court have recommended that four judicial officers and an advocate be elevated as judges of the Madhya Pradesh High Court.

The Collegium in its resolution made a note that judicial officers Akhil Kumar Shrivastava,  Brij Kishore Shrivastava, Rajendra Kumar Shrivastava, and Mohd. Fahim Anwar were not among the five most senior officers. It was recorded that this being the case, they had perused the minutes of the meeting of the High Court Collegium, held on July, 18, 2017, which recorded the reasons for not proposing the names of the senior officers. The Supreme Court Collegium agreed with the reasoning of the High Court Collegium in not recommending the said officers.

The Resolution also dwelt upon the fact that a complaint had been made against one of the four officers, but opined that it was frivolous in nature and deserved to be ignored.

Advocate Sanjay Dwivedi has also been recommended for elevation.

The Madhya Pradesh High Court currently has a sanctioned strength of 53 as against a working strength of 33.

In a separate resolution, the Collegium resolved to confirm the elevation of additional judge of the Punjab and Haryana High Court, Justice Ramendra Jain as a permanent judge. The Collegium resolved that the same be done expeditiously, in light of observations made by the Department of Justice relating to an impending proposal to transfer Justice Jain to the Karnataka High Court, and the fact that his tenure as an additional judge is set to expire on April 19 this year.
